TRIAL ALERT: WEEK OF JUNE 21, 2010
State vs. Timothy Thomas (Hank Aaron Drive Teen Shooting) -fight leads to Shootout on Hank Aaron Drive)
Defendant Thomas is accused of shooting 16-year Nicholas Martin on April 5, 2009 at the corner of Hank Aaron and Haygood Drives. The victim was walking with several friends when a gunman stepped out of a vehicle and opened fire on the teenagers. The victim was shot in the back of the head as he ran from the gunman and died of his injuries the next day. Another teen (his half brother) was shot in the neck and lost his eye, but survived. A third teenager was shot in the ankle. Thomas is charged with Murder, Felony Murder (two counts), Aggravated Assault with a Deadly Weapon (three counts), Aggravated Battery, Possession of a Firearm During the Commission of a Felony and Possession of a Firearm by a Convicted Felon. Opening statements will begin at 9AM Tuesday in Fulton County Superior Court, Judge Henry Newkirk presiding, courtroom 4A.
